BILL AIMS TO CLARIFY & UPDATE WORKERS' COMPENSATION LAW
Hoping to clarify rules for independent contractors, Rep. Mark Mustio, R-Allegheny, introduced House Bill 1215, which would ensure general contractors are not liable for uninsured subcontractors when those subcontractors are not covered by workers' compensation insurance. Under this bill, independent contractors may register with the state Department of Labor and Industry to certify their status. When an independent contractor certifies that he or she is exempt from the act, the independent contractor will be barred from filing a claim against a general contractor. The bill sets strict penalties for anyone who falsifies documents or forces employees to falsify their status as independent contractors. For more information, please contact Jill Pento at PBA
